Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pegasus Lenders Group LLC platform ("Pegasus," "Platform") at pegasuslenders.com. By accessing or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, submitting a deal, or otherwise using any part of the Pegasus platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

2. Platform Description

Pegasus is a marketplace platform that connects lenders, borrowers, real estate agents, and mortgage brokers for the purpose of facilitating real estate and business financing introductions.

Pegasus is not a lender, broker, or financial advisor. We do not originate loans, guarantee financing, or provide investment advice. All lending decisions are made solely by the independent lenders in our network.

3. User Accounts

To access most features of the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and not share account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that provide false or misleading information.

4. Lender & Borrower Responsibilities

Lenders agree to:

• Hold all required licenses and comply with applicable lending laws in their jurisdiction
• Provide accurate information about their loan programs, rates, and criteria
• Treat all borrowers fairly and without discrimination
• Respond to matched borrower inquiries in a timely manner

Borrowers agree to:

• Provide accurate financial and property information when submitting deals
• Only submit legitimate financing requests for real transactions
• Not submit multiple duplicate applications for the same property

5. Partner Program Terms

Agents and brokers participating in the Partner Program agree to:

• Comply with all applicable licensing requirements in their state
• Only connect clients with marketplace participants with their knowledge and consent
• Not misrepresent the Pegasus platform or any lender's terms to clients
• Membership fees are for platform access, profile tools, marketplace visibility, communication tools, dashboards, education, RWA tools, network badge tools, and other actual platform services
• Pegasus reserves the right to modify membership tiers with 30 days notice

6. Prohibited Activities

You may not use the Platform to:

• Submit false, misleading, or fraudulent information
• Impersonate any person or entity
• Engage in predatory lending practices or discriminatory behavior
• Scrape, copy, or redistribute platform data without authorization
• bypass platform terms after being matched
• Harass, threaten, or abuse other platform users
• Violate any applicable law or regulation

7. Disclaimers & Limitations

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. PEGASUS DOES NOT GUARANTEE THAT ANY BORROWER WILL RECEIVE FINANCING OR THAT ANY LENDER WILL RECEIVE QUALIFIED DEAL FLOW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEGASUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Los Angeles County, California.
